Purpose:

The MCON Group of Companies is committed to maintaining a safe and productive work environment for all employees. This policy outlines the company’s stance on substance use, including THC, and provides guidelines for employees.

Prohibited On-Site Use: While the MCON Group of Companies does not deny employment based on THC-positive drug tests, employees are strictly prohibited from being under the influence of any substances, including THC, while on the job site. This includes impairment that affects job performance, safety, or the well-being of others.

Pre-Employment Drug Testing: As part of the hiring process, employees may be subject to pre-employment drug testing. A positive THC result will not automatically disqualify an applicant from employment.

On-the-Job Testing: If there is a reasonable suspicion that an employee is under the influence of substances, including THC, while on the job site, The MCON Group of Companies reserves the right to conduct on-the-job testing. This may include observable signs of impairment, erratic behavior, or involvement in a workplace accident.

Positive Test Results for THC: If an employee tests positive for THC but is not under the influence while on the job site, the MCON Group of Companies will not take adverse action based solely on the positive test result. However, employees are encouraged to disclose any prescription or medical use of THC to avoid misunderstandings.

Disciplinary Actions for On-Site Impairment: If an employee is found to be under the influence of THC while on the job site, disciplinary actions may be taken. These actions may include counseling, suspension, or termination, depending on the severity and frequency of the violation.

Confidentiality: All information related to drug test results and on-the-job impairment will be treated confidentially to the extent permitted by law. Access to this information will be restricted to individuals involved in the drug-testing process and those responsible for making employment decisions.

Rehabilitation and Assistance: The MCON Group of Companies acknowledges that substance abuse is a treatable condition. Employees found to be under the influence may be provided with information on available rehabilitation and assistance programs.

Compliance with Applicable Laws: This policy is intended to comply with all applicable federal, state, and local laws. If any provision of this policy conflicts with applicable law, the law shall prevail.

Review and Modification: The MCON Group of Companies reserves the right to review and modify this policy as needed to ensure its continued effectiveness and compliance with relevant laws and regulations.
